General Terms and Conditions of Deutschkurse bei der Universität München e.V. (a registered, public-benefit organisation)
(hereinafter Deutschkurse) – updated 09 December 2020
 
1. A high school diploma recognized in Germany under the rules of the central office for studies abroad (“Zentralstelle für das Auslandsschulwesen”) is required for admittance to a Deutschkurse course.

2. A contract of education is valid only after Deutschkurse send a confirmation of the course registration. This occurs only after the course participant has paid the registration fee. A registration is considered a reservation as long as the registration fee has not cleared the bank account of Deutschkurse. The registration expires if the registration fee does not clear the account 14 days at the latest prior to the start of the course. The registration fee will be credited against the course fee.

3. By paying the registration fee the course participant accepts the General Terms and Conditions of Deutschkurse as binding.

4. Bank fees without exception are the responsibility of the course participants. In case of reimbursement, any fee for a credit card transaction will be deducted.

5. Registrations generally are possible only for the entire course, however, Deutschkurse can make exceptions to allow partial attendance in reasonable cases. For a course lasting two months the participant has to attend a minimum of half of the course. If a participant attends a minimum part of a course as described in this rule, Deutschkurse will increase the fee for the course proportionately. (The rates are listed in the current price list.)

6. Students who are enrolled at the following universities benefit from a reduction for courses listed as “reduced” in the current price list: Ludwig-Maximilians-Universität, Technische Universität München, Hochschule für Politik, Akademie der Bildenden Künste, Hochschule für Musik, Hochschule München, Universität der Bundeswehr München, Hochschule für Philosophie München, Technische Universität Weihenstephan.

7. Students are placed in the appropriate course level on the basis of an entry-level test which normally takes place two to four weeks prior to the start of the course. Certificates of attendance at other language schools cannot replace the test. Students have no right to attend a course that is a higher level than the one they are placed in by their test results.

8. When booking the option "time of day according to availibility" individual preferences are considered to the extent possible when participants are assigned to morning or afternoon courses, however, there is no right to a course at a specific time of day. If Deutschkurse are unable to respect such a wish, this is not accepted as a reason for reimbursement of the fees.

9. If a course is held as a face-to-face course, courses take place at the following locations in Munich: Agnesstraße 27, Karl-Theodor-Straße 69, rooms of the LMU München. Locations cannot be chosen individually, but are assigned by Deutschkurse.

10. By registering, the participants obligate themselves to attend the course on a regular basis. Deutschkurse will issue a confirmation of participation only to participants who attended the courses regularly.

11. To advance to the next level a participant must pass a special intermediate test.

12. Deutschkurse offer the following chargeable examinations:
  • telc Deutsch B1
  • telc Deutsch B2
  • “Deutsche Sprachprüfung für den Hochschulzugang” (DSH) – the universal examination that foreign-language-speaking applicants for a place at a German university must pass in order to be admitted.
  • TestDaF
13. Withdrawal of the contract of education between Deutschkurse and the participant is possible only until five business days before the start of the course at the latest. In case of a withdrawal, Deutschkurse will reimburse the subscription for the course, upon demand, and deduct the registration fee. This also applies to revocation. Withdrawal or cancellation is not possible within the five business days before start of the course and during the period of time the course takes place (between the first and the last day of the course). There is no right to cancellation according to § 627 BGB (“Bürgerliches Gesetzbuch,” the German Civil Code; and § 627 discusses the extraordinary notice of cancellation of superior services). The right to cancel without notice due to important reasons remains unaffected.

14. Withdrawal of an examination is possible only until the end of the application period. In case of such a withdrawal, Deutschkurse will retain a handling fee. (The rates are listed in the current price list.) In case of a withdrawal after the end of the application period, Deutschkurse will retain the entire examination fee. There is no right to cancellation according to § 627 BGB. The right to cancel without notice due to important reasons remains unaffected.

15. Cancellations and withdrawals must be submitted in writing.

16. If Deutschkurse have issued a confirmation of registration for submission to a German authority, any fee can solely be reimbursed after Deutschkurse have retrieved the original issue of this confirmation.

17. Deutschkurse reserve the right to merge, delay, hold online or hybrid or cancel a course if there is an insufficient number of participants or if circumstances arise for which they are not responsible.
17.1 In the case of a course being held as an online or hybrid course, it is up to the participant to create the necessary technical requirements.
17.2 In case of withdrawal due to Deutschkurse, the participant is refunded any paid fees. The participant cannot assert further claims, in particular compensation for damages.

18. Unless otherwise specified in these General Terms and Conditions, including the subsequent regulations, Deutschkurse are liable in case of breach of contractual and non-contractual obligations according to the applicable regulations. Regardless of the legal reason, Deutschkurse are liable for damages in the event of wilful intent and gross negligence. In the event of simple negligence, Deutschkurse are liable only
a) for damages resulting from an injury of life, body or health,
b) for damages resulting from the breach of a fundamental contractual obligation (contractual obligation which is essential for the proper fulfillment of the contract and the other party typically, visibly and justifiably relies on); in this case the scope of liability is limited to the scope of case which will be typically foreseen.

Information on Cancellation of Online Registrations

Right to Cancellation
You are entitled to cancel your contract within two weeks in writing (e.g., letter, fax, e-mail) without stating your reasons. The period begins upon receipt of this policy information in writing, but not prior to the conclusion of the contract, nor before we have fulfilled our obligations to provide information as defined in Article 246, Section 2, in conjunction with Section 1, paragraphs (1) and (2) of the Introductory Act to the [German] Civil Code (Einführungsgesetz zum Bürgerlichen Gesetzbuch, EGBGB). To comply with the cancellation deadline, it is sufficient to send your cancellation within the stipulated period. The cancellation must be sent to:

Consequences of Cancellation
In the event of a valid cancellation, goods and services received by either party, and derived benefits (e.g., interest), if applicable, must be returned. In the event that you cannot return the goods or services received in whole or in part, or only in a deteriorated condition, you will be obliged to compensate us for any depreciation in value, if applicable. This may result in your nevertheless having to satisfy the contractual payment obligations for the period up until cancellation. Obligation to refund payments must be met within 30 days. The period begins for you with the sending of your cancellation, and for us upon receipt of your cancellation.
Your right to cancellation expires prematurely if the contract is completely fulfilled by both parties at your explicit request before you have exercised your rights to cancellation.
